The Australian Tax Office has released draft tax ruling TR 2008/D6 on what constitutes a genuine redundancy for tax purposes.
The ruling makes it clear that convenient deals between companies and their departing employees, where payments are artificially labelled as redundancy payments just to take advantage of concessional tax rules don’t stand up.
